Express Entry wait check
Rule: IRCC states it processes most Express Entry permanent residence applications within about 6 months of a complete application. See Express Entry: after you apply.
Ask through the inquiry form if you want a lawyer to review a long Express Entry wait.
As of IRCC's processing times tool update on October 9, 2026 (recorded on this site's processing-times tracker), Canadian Experience Class was about 6 months, Federal Skilled Worker about 7 months, and Express Entry provincial nominee files about 7 months. IRCC also states that it processes most Express Entry permanent residence applications within 6 months of a complete application. When a file sits far past those figures with little movement, applicants often check status, use the web form, request notes, and, in some cases, ask the Federal Court for a mandamus order that IRCC decide.
Use the wait tool and tracker cards at the top of this page for your submission date and the recorded times. IRCC's Express Entry after you apply page says most Express Entry applications are processed within 6 months or less of a complete application, and lists common delay drivers such as verification, criminal or security issues, extra background checks, unclear family situations, and requests for more documents or an interview.
Those published times are not a guarantee that every file finishes on schedule. They are the baseline courts and applicants use when asking whether a wait has become unreasonable.
IRCC's status page directs Express Entry applicants to the IRCC secure account and the Client Application Status tool after they have an acknowledgement of receipt.
The IRCC web form lets you ask about an application that is over the normal processing time, update contact details, or submit documents. The same page says submitting another web form will not speed processing, and that agents do not have more detail than what is available online.
Officer notes live in IRCC's Global Case Management System (GCMS). To obtain records IRCC holds about an application, use IRCC's Access to Information request process (ATI fee $5.00 where that Act applies). Federal Court reasons in delay cases often turn on what those notes show about activity, holds, and security screening.
Respond to every IRCC request for documents or biometrics. Gaps you control weaken a later claim that the delay is IRCC's alone.
Mandamus is a Federal Court order that a public authority perform a legal duty it has failed to perform. In immigration delay cases, applicants ask the Court to compel IRCC to process and decide a file that has sat without a decision.
The Court applies the mandamus framework from Apotex Inc v Canada (Attorney General), [1994] 1 FC 742 (FCA). For delay, it uses the three Conille factors: whether the wait is longer than the nature of the process requires, whether the applicant caused the delay, and whether IRCC has given a satisfactory justification (Conille v Canada (Minister of Citizenship and Immigration), [1999] 2 FC 33).
Mandamus does not approve permanent residence. It forces a decision (approve or refuse) on a timeline the Court sets when the test is met.
| Field | Detail |
|---|---|
| Application type | Express Entry Federal Skilled Worker permanent residence; mandamus |
| Alleged | Unreasonable delay (about 49 months from March 2021 submission) |
| Outcome | Mandamus granted; IRCC ordered to process within 90 days |
| Court reason (quote) | "the Minister has failed to provide a meaningful justification for the delay" |
| Link | 2025 FC 987 |
The Court found a long gap of inactivity in the GCMS notes and treated a bare "security checks" statement as inadequate without evidence of the complexity of those checks.
| Field | Detail |
|---|---|
| Application type | Study permit; mandamus (same delay test used in Express Entry files) |
| Alleged | About 15 months of delay past an expected short study-permit timeline |
| Outcome | Mandamus dismissed |
| Court reason (quote) | "The Respondent has provided a reasonable justification for the delay." |
| Link | 2026 FC 1090 |
The Court held the applicant failed to prove the service standard with evidence, and accepted documented military-record requests plus security screening as justification. The same Conille and Apotex tests apply to Express Entry waits; a long clock alone is not enough if IRCC shows real, file-specific work.
Mandamus is a poor fit while you still owe documents, while a required interview has not happened because of your travel, or while IRCC has explained active screening with file-specific evidence. It is also not a substitute for fixing an incomplete Express Entry profile. See Express Entry profile ineligible if IRCC marked the profile ineligible.
Compare posted times for CEC, FSW, and PNP on the processing-times tracker and on BC PNP vs Express Entry.
Waiting more than a year on Express Entry? Send us your application date and stream through the inquiry form, and a licensed immigration lawyer can tell you whether a mandamus application makes sense.
